Terms of Service

1. Acceptance of Terms

By using Looksmith ("the Service"), operated by Bartas Urba LLC ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Looksmith is a product of Bartas Urba LLC. It is a web application that generates AI headshots from user-uploaded reference selfies. The Service trains a reusable AI model of your likeness and produces professional-quality photos for LinkedIn, team pages, speaker bios, and other corporate uses.

3. Eligibility

You must be at least 18 years old to use Looksmith. By creating an account, you confirm that you meet this requirement.

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

5. Acceptable Use

You agree to use Looksmith only for lawful purposes. You may only create AI models of yourself or of individuals who have given you explicit written consent. You may not:

• Create AI models or photos of any person without their consent
• Generate nude, sexually explicit, or pornographic content
• Upload photos of minors
• Use the Service to impersonate, harass, defame, or defraud any person
• Use generated photos in any way that violates applicable law

6. Content Ownership

You retain ownership of all photos you upload to Looksmith and all AI-generated images you create through the Service. By using the Service, you grant Looksmith a limited, non-exclusive license to process and store your uploaded content solely for the purpose of delivering the Service to you.

7. Subscriptions and Billing

Looksmith offers monthly subscription plans. By subscribing, you authorize recurring monthly charges to your payment method. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Unused credits do not roll over to the next billing cycle.

8. Immediate Access and Waiver of Withdrawal

Looksmith provides instant access to digital content and begins service consumption immediately upon purchase. GPU processing resources are reserved and expenses are incurred at the time of use. By proceeding with a purchase, you acknowledge this and explicitly waive the standard 14-day withdrawal period.

9. Termination

You may cancel your subscription at any time through the billing portal. Looksmith reserves the right to suspend or terminate your account for violation of these Terms, with or without notice.

10. Limitation of Liability

Looksmith is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Looksmith's total liability for any claim arising from your use of the Service is limited to the amount you paid in the 12 months preceding the claim. Looksmith is not liable for any indirect, incidental, or consequential damages.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Privacy Policy

1. Information We Collect

We collect the following information when you use Looksmith:

• Account information: email address and authentication credentials
• Payment information: processed securely through Stripe; we do not store your card details
• Uploaded content: reference selfies and AI-generated headshots
• Usage data: IP address, browser type, device information, and pages visited

2. How We Use Your Information

We use your information to:

• Provide, maintain, and improve the Service
• Process payments and manage your subscription
• Communicate with you about your account and the Service
• Comply with legal obligations

3. Data Sharing

We do not sell your personal information. We share data only with:

• Service providers: payment processors (Stripe), cloud infrastructure, and AI model providers necessary to deliver the Service
• Legal requirements: when required by law or to protect our rights

4. Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. When you delete your account, we remove your personal information and uploaded content within 30 days, except where retention is required by law.

5. Your Rights

You may request access to, correction of, or deletion of your personal data by contacting us. If you are in the EU, you have additional rights under the GDPR including data portability and the right to object to processing.

6. Cookies and Analytics

We use cookies and analytics tools to understand how the Service is used and to improve your experience. You can control cookie settings through your browser.

7. Children

Looksmith is not intended for use by anyone under 18. We do not knowingly collect information from minors. If we learn that a minor has provided personal information, we will delete it promptly.

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting a notice on the Service.

Refund Policy

Due to the high costs associated with GPU processing, we are unable to offer refunds once headshot generation has begun, as server resources are reserved and expenses are incurred at the time of use. If you experience a technical issue that prevents delivery of your headshots, please contact us and we will work to resolve it or provide account credit at our discretion.

You may cancel your subscription at any time to prevent future charges. Cancellation takes effect at the end of your current billing period.
